Terms of Service

1. Eligibility

To use BikerOrNot, you must:

• Be at least 18 years of age.
• Reside in a jurisdiction where the Platform is available.
• Not be prohibited from using the Platform under applicable law.
• Not have a previously terminated BikerOrNot account due to a violation of these Terms.
• Not be required to register as a sex offender, or be subject to any similar offender registry, in any jurisdiction.

By using the Platform, you represent and warrant that you meet all eligibility requirements. We may, at our sole discretion, refuse service, terminate accounts, or remove content if we believe eligibility requirements have not been met.

2. Account Registration

To access most features of the Platform, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information, including your first name, last name, zip code, and relationship status.
• Maintain and promptly update your account information to keep it accurate and current.
• Keep your password confidential and not share it with any third party.
• Create and maintain only one personal account, and not buy, sell, rent, transfer, or allow any other person to use your account.
• Notify us immediately at support@bikerornot.com if you suspect any unauthorized use of your account.

You are solely responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that provide inaccurate, false, or misleading information.

Your username is provided for your use on the Platform and remains subject to these Terms. We may reclaim, change, or require you to change a username that is inactive, that infringes a trademark or other right, that impersonates another person, or that we otherwise determine is inappropriate. A username is not a property right and confers no ownership interest.

Phone Verification

BikerOrNot may offer, or require, verification of a mobile phone number — during registration or at other times — as a condition of accessing certain features or to help us confirm that you are a real person and reduce fraud, spam, and scam activity. If you choose or are required to verify a phone number, you agree that:

• You are authorized to use the phone number you provide.
• We may send a one-time verification code by SMS to that number. Message and data rates may apply, and message frequency varies. Verification messages are transactional and are not marketing messages.
• We use a third-party service provider to deliver verification messages and to assess whether a number carries elevated fraud risk (for example, certain virtual or VoIP numbers), and we may decline to verify such numbers.
• Completing verification may cause a verification badge to be displayed on your profile. A badge indicates only that a verification step was completed; it is not a guarantee of any user’s identity, intentions, conduct, or safety (see Section 5.3).
• We may decline to verify, or may revoke verification for, any number at our discretion.

3. User Content

3.1 Content You Post

The Platform allows you to post, upload, and share content including text, photos, videos, and other materials (“User Content”). You retain ownership of any intellectual property rights you hold in your User Content. You represent and warrant that you own, or have obtained all rights, licenses, consents, and permissions necessary to post, your User Content, and that your User Content does not and will not infringe, misappropriate, or violate the intellectual property, privacy, publicity, or other rights of any third party.

3.2 License to BikerOrNot

By posting User Content on the Platform, you grant BikerOrNot a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, create derivative works of, communicate, publish, publicly display, and distribute such User Content in connection with operating, improving, marketing, and promoting the Platform and our services, including in advertisements, promotional emails, social media, and other marketing materials, in any media now known or later developed.

We will not use your name, voice, image, or likeness to indicate your personal endorsement of a product or service without your separate consent. If you do not wish to have your User Content used in our marketing materials, you may contact us at support@bikerornot.com, and we will make reasonable efforts to honor that request on a going-forward basis. This license ends when you delete the relevant User Content or your account, except for content that others have shared or used under this license and not deleted, or where retention is required by these Terms or by law.

3.3 Content Standards

You agree that you will NOT post User Content that:

• Is false, misleading, or deceptive.
• Is defamatory, obscene, pornographic, vulgar, or offensive.
• Promotes discrimination, bigotry, racism, hatred, or harm against any individual or group.
• Violates or infringes any third party’s intellectual property, privacy, or other rights.
• Contains spam, chain letters, pyramid schemes, or commercial solicitation.
• Contains viruses, malware, or any other malicious code.
• Violates any applicable law or regulation.
• Harasses, bullies, intimidates, or threatens other users.

3.4 Content Moderation and Automated Systems

We reserve the right, but are not obligated, to review, screen, and remove any User Content at any time and for any reason, including content that we determine, in our sole discretion, violates these Terms or may be harmful to the Platform, its users, or third parties. Group Admins may also remove User Content from their groups in accordance with Section 6.

BikerOrNot uses both human review and automated systems, including artificial intelligence, to help operate the Platform — including to moderate content, detect spam and fraud, score and identify potentially harmful accounts, and rank and recommend content. These systems are not perfect and may produce errors, including incorrectly flagging, removing, restricting, or recommending content or accounts, and failing to detect violations. To the maximum extent permitted by law, BikerOrNot is not liable for any action, inaction, or error of its human or automated moderation and safety systems, and all such decisions are made in our sole discretion.

4. Community Guidelines

BikerOrNot is a community built for motorcycle enthusiasts. We expect all members to treat one another with respect. You agree to use the Platform in a manner consistent with all applicable laws and these Terms. Specifically, you agree not to:

• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Stalk, harass, or harm another user.
• Collect or harvest any personally identifiable information from the Platform without authorization.
• Use the Platform for any commercial solicitation, advertising, or spam without our prior written consent.
• Circumvent, disable, or otherwise interfere with security-related features of the Platform.
• Access or use the Platform in a way that could damage, disable, overburden, or impair our servers or networks.
• Use automated tools (bots, scrapers, crawlers, or similar technologies) to access or interact with the Platform without our prior written consent.
• Use content from the Platform to train, fine-tune, or otherwise develop artificial intelligence or machine learning models without our express written permission.
• Modify, adapt, translate, decompile, disassemble, reverse engineer, or create derivative works of the Platform or any of its underlying software, except to the limited extent this restriction is prohibited by applicable law.

5. Social Features and Member Interactions

5.1 Social Features

The Platform provides social networking features including friend connections, direct messaging, commenting, content sharing, groups, and notifications. These features are provided to facilitate genuine community interaction among motorcycle enthusiasts. You agree to use these features responsibly and in accordance with these Terms.

To help protect our community from scams, fraud, and abuse, BikerOrNot may use automated systems, including artificial intelligence, to review messages, comments, and other content shared on the Platform. This monitoring is conducted solely for safety and security purposes. Accounts identified as engaging in scam or fraudulent activity may be suspended or terminated without notice.

We are not responsible for User Content shared via direct messages or posted by other users. If you receive content that you believe violates these Terms, please use our reporting tools to notify us. We also provide blocking tools to allow you to restrict unwanted contact from other users.

The Platform is supported in part by advertising. We, and parties acting on our behalf, may display advertisements, sponsored content, and other promotional materials on the Platform. Your dealings with, or participation in promotions of, any advertiser are solely between you and that advertiser, and we are not responsible for any loss or harm arising from those dealings.

5.2 Sole Responsibility for Interactions

You are solely responsible for your interactions with other users of the Platform, whether those interactions occur on or off the Platform. BikerOrNot is a venue that allows users to connect; we are not a party to, and have no responsibility for, any interaction, communication, relationship, dispute, transaction, or meeting between users.

5.3 No Screening or Background Checks

BikerOrNot does not conduct criminal background checks or otherwise screen its users. We do not vouch for, endorse, or guarantee the identity, intentions, conduct, character, or safety of any user. Safety features such as verification badges or scam-detection systems are provided on a best-effort basis, may be inaccurate, and do not constitute a representation that any user is safe, trustworthy, or who they claim to be.

5.4 In-Person Meetings

If you choose to meet another user in person, you do so entirely at your own risk. BikerOrNot does not supervise, organize, or take part in meetings between users. We strongly encourage you to meet in public places, tell someone where you are going, and exercise caution. You assume all risks associated with meeting other users, including the risk of personal injury, property loss, or death.

5.5 Rides, Events, and Group Activities

The Platform allows users to organize, list, promote, and discover rides, group rides, events, rallies, meetups, and similar activities. BikerOrNot does not organize, sponsor, host, lead, endorse, inspect, supervise, or ensure the safety of any ride, event, or activity arranged, listed, or promoted through the Platform, including any activity appearing in our events features. Any such activity is organized and conducted solely by the users involved.

If you participate in a ride, event, or other activity with users you connect with through the Platform, you do so entirely at your own risk. You are responsible for your own conduct, your equipment and its mechanical condition, your compliance with traffic and other laws, and your decision whether and how to participate. You assume all risks associated with these activities, including motor vehicle accidents, collisions, mechanical failure, hazardous road, traffic, or weather conditions, the conduct of other participants or third parties (including impaired, reckless, unlicensed, or uninsured riders), theft, property damage, serious personal injury, and death. BikerOrNot is not responsible for, and disclaims all liability arising from, any ride, event, meetup, or activity, or the acts or omissions of any ride leader, event organizer, host, or participant.

5.6 Classifieds and Member Transactions

The Platform may allow users to list, advertise, buy, and sell motorcycles, parts, gear, and other items (“Classifieds”). BikerOrNot provides Classifieds only as a venue. We are not a party to, broker of, agent for, or participant in any transaction between users, and we are not a payment processor, escrow service, shipper, or auctioneer.

All items are listed and sold on an “as is” and “where is” basis. BikerOrNot does not inspect, authenticate, or verify any item or listing and makes no representation or warranty regarding any item or transaction, including its description, photographs, price, condition, quality, mechanical soundness, safety, mileage or odometer accuracy, legality, ownership, title or lien status, or whether an item is stolen, counterfeit, or accurately described. We do not guarantee that any buyer or seller will complete a transaction, make payment, deliver an item, or have authority to sell.

You are solely responsible for your transactions, including inspecting the item, verifying the other party, confirming ownership and clear title, and complying with all applicable laws (including title transfer, lien release, odometer disclosure, registration, and tax obligations). You buy and sell entirely at your own risk. BikerOrNot is not responsible for, and disclaims all liability arising from, any Classifieds listing or transaction, including fraud, scams, non-payment, non-delivery, chargebacks, counterfeit or stolen goods, or disputes between buyers and sellers.

5.7 Financial Transactions and Fraud

BikerOrNot is not a payment service and is not involved in any financial transaction between users. You should never send money, gift cards, cryptocurrency, or financial or personal account information to another user. Romance scams and other fraud schemes are common on social platforms. BikerOrNot is not responsible for, and you release us from, any loss arising from money or value you transfer to, or any fraud committed by, another user — regardless of whether you were introduced through the Platform and regardless of whether related communications occurred on or off the Platform.

5.8 Release of Claims

To the maximum extent permitted by law, you release BikerOrNot and its officers, directors, employees, and agents from all claims, demands, damages, losses, and liabilities of every kind, known and unknown, arising out of or in any way connected with your interactions, communications, transactions, disputes, or meetings with other users. This release does not apply to claims arising from BikerOrNot’s own gross negligence, willful misconduct, or fraud.

5.9 California Residents

If you are a California resident, you waive California Civil Code § 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

5.10 Member Referrals and Invitations

BikerOrNot may allow certain members to invite others to join the Platform through referral or invitation links, codes, or similar mechanisms (“Referrals”). Eligibility to send Referrals is granted at our sole discretion and may be limited, conditioned, paused, or revoked at any time, with or without notice. Referral eligibility and any associated status or limits are not property rights and confer no ownership interest, compensation, or ongoing entitlement.

If you send or use a Referral, you agree that:

• You will only invite people you actually know and reasonably believe would welcome the invitation. You will not post Referral links or codes publicly, distribute them through spam, or use them to solicit strangers.
• You will not sell, trade, or offer anything of value in exchange for sending or using a Referral, and you will not use Referrals in connection with any deceptive, fraudulent, or abusive activity.
• Members who join through a Referral remain subject to all eligibility requirements, content standards, and safety checks in these Terms, including automated and human review. Being referred does not exempt any member from these requirements.
• We may record the relationship between inviting and joining members for security, anti-fraud, analytics, and community-integrity purposes, as described in our Privacy Policy.
• We may suspend, limit, or revoke your ability to send Referrals, and may take account-level action, if members you invite are repeatedly banned, reported, or found to violate these Terms, or if you otherwise misuse the Referral system.

6. Groups and Group Administrators

6.1 Groups

The Platform allows users to create and join groups organized around motorcycle-related interests, locations, riding styles, clubs, or other topics. Groups may be public or private. Public groups may be joined by any user; private groups require the group creator’s or an administrator’s approval of a join request, or an invitation, as a condition of membership.

6.2 Group Administrators

Each group is managed by one or more users serving as group administrators or moderators (“Group Admins”). Group Admins are members of the BikerOrNot community, not employees, agents, or representatives of BikerOrNot. Their actions and decisions are their own and do not reflect the views or policies of BikerOrNot.

6.3 Admin Authority

Group Admins have broad discretion to manage their groups, including but not limited to: establishing group-specific rules; approving or denying membership requests; removing posts and comments within the group; blocking, banning, or removing members; changing group settings, description, category, location, cover image, or privacy level; appointing or removing additional administrators or moderators where the Platform provides such functionality; and dissolving the group. Group Admins may take these actions for any reason or no reason, provided their actions do not themselves violate these Terms or applicable law. Dissolving a group may permanently remove the group and all content posted within it, including content posted by other members.

6.4 Group Rules

Group Admins may establish rules specific to their group in addition to these Terms. Members of a group agree to abide by any posted group rules as a condition of participation. Group rules may be stricter than these Terms but may not authorize conduct that these Terms prohibit.

6.5 No Mediation of Group-Level Decisions

BikerOrNot does not generally intervene in or review decisions made by Group Admins regarding their own groups, including decisions to remove or block members. If you are removed or blocked from a group, your recourse is to contact the Group Admin directly or to find another group. BikerOrNot is not responsible for, and disclaims all liability arising from, the actions or decisions of Group Admins.

6.6 Platform-Wide Violations

Notwithstanding Section 6.5, BikerOrNot reserves the right to review and reverse any Group Admin action that we determine, in our sole discretion, violates these Terms, our Community Guidelines, or applicable law. We may also remove a Group Admin’s privileges, dissolve a group, or take account-level action against a Group Admin for misuse of their role.

6.7 User-to-User Blocking

The Platform provides tools that allow any user to block any other user, restricting that user’s ability to view their profile, message them, or interact with their content. Blocking decisions made by individual users are personal and are not subject to review or reversal by BikerOrNot.

6.8 Becoming and Ceasing to Be a Group Admin

A user becomes a Group Admin by creating a group or, where the Platform provides such functionality, by being appointed by an existing Group Admin. Group Admin status may be relinquished voluntarily or revoked by BikerOrNot at our discretion. Group Admin status is not a property right and confers no compensation or ongoing entitlement.

7. Privacy

Your privacy is important to us. Our Privacy Policy, incorporated herein by reference, explains how we collect, use, and protect your personal information. By using the Platform, you consent to the data practices described in our Privacy Policy.

Your profile information, including your name and general location (zip code area), may be visible to other registered users of the Platform. You can adjust your privacy settings from your account dashboard.

8. Electronic Communications

By creating an account on BikerOrNot, you consent to receive electronic communications from us, including notifications, account-related messages, and service announcements delivered via email, in-app notifications, or other electronic means. These communications may include:

• Account activity notices (e.g., friend requests, direct messages, post interactions, group invitations).
• Operational and security updates (e.g., account activity alerts, policy changes).
• Legal notices required by applicable law, including copyright infringement notices.

You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. You may adjust notification preferences from your account settings, but certain operational and legal communications cannot be opted out of while you maintain an active account.

9. Intellectual Property

The Platform and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of BikerOrNot and its licensors. Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent.

Subject to your compliance with these Terms, BikerOrNot grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Platform for your personal, non-commercial use. You may not resell or commercially exploit the Platform, use it other than as expressly permitted by these Terms, or remove any proprietary notices it displays. All rights not expressly granted to you in these Terms are reserved by BikerOrNot and its licensors.

If you believe that your copyrighted work has been infringed on the Platform, please refer to Section 10 below and our full DMCA Copyright Policy, or contact us at dmca@bikerornot.com.

10. Copyright Infringement and DMCA

BikerOrNot respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512. Our complete DMCA Copyright Policy is incorporated herein by reference.

10.1 Reporting Infringement

If you believe content on the Platform infringes your copyright, you may submit a written takedown notice via our online form or by emailing our designated DMCA agent at dmca@bikerornot.com. Valid notices must meet all requirements of 17 U.S.C. § 512(c)(3). Knowingly submitting a false infringement notice may expose you to liability under 17 U.S.C. § 512(f).

10.2 Counter-Notices

If you believe your content was removed as a result of mistake or misidentification, you may submit a counter-notice via our counter-notice form. Upon receipt of a valid counter-notice, we will forward it to the original complainant. Removed content may be restored no sooner than 10 and no later than 14 business days after receipt, unless the complainant files a court action (17 U.S.C. § 512(g)(3)).

10.3 Repeat Infringer Policy

In accordance with the DMCA, BikerOrNot has adopted a repeat infringer policy. Users who accumulate multiple valid copyright infringement strikes against their account may have their account suspended or permanently terminated at our sole discretion. We may also limit or terminate access for users who infringe the intellectual property rights of others, even in the absence of repeated violations.

11. Third-Party Links and Services

The Platform may contain links to third-party websites or services that are not owned or controlled by BikerOrNot. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We encourage you to review the terms and privacy policies of any third-party sites you visit.

12. Disclaimers

The Platform is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

BikerOrNot does not warrant that: (a) the Platform will function uninterrupted, securely, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Platform is free of viruses or other harmful components; or (d) the results of using the Platform will meet your requirements.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall BikerOrNot, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Platform.
• Any conduct or content of any third party on the Platform, including actions or decisions of Group Admins.
• Any content obtained from the Platform.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our aggregate liability to you exceed the greater of one hundred dollars ($100) or the amounts paid by you to BikerOrNot in the past twelve (12) months.

14. Indemnification

You agree to defend, indemnify, and hold harmless BikerOrNot and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney’s fees), resulting from or arising out of: (a) your use of and access to the Platform; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your User Content caused damage to a third party.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before initiating any formal dispute proceeding, you agree to first contact us at legal@bikerornot.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

15.2 Binding Arbitration

If we cannot resolve the dispute informally, you and BikerOrNot agree to resolve any claims through final and binding arbitration, except as set forth under the exceptions below. The arbitration shall be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) rules.

15.3 Class Action Waiver

You and BikerOrNot agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

15.4 Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court, and either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. To the extent arbitration does not apply, you agree to submit to the exclusive personal jurisdiction of the courts located in Delaware for the resolution of any dispute.

17. Account Suspension and Termination

17.1 Suspension

We may temporarily suspend your account at any time, without prior notice, if we have reason to believe you have violated these Terms, your account has been compromised, or suspension is necessary to protect the Platform or other users. We will notify you of a suspension and the reason for it via the email address on file where reasonably practicable.

17.2 Termination by Us

We may terminate your account permanently, without prior notice or liability, for any reason, including repeated or serious violations of these Terms, accumulation of copyright infringement strikes under our repeat infringer policy, conduct harmful to the community, or failure to meet eligibility requirements. Upon termination, your right to use the Platform will immediately cease.

17.3 Termination by You

You may delete your account at any time through your account settings. Upon account deletion, your profile will be removed from public view, though we may retain certain data as required by applicable law or as described in our Privacy Policy.

17.4 Limiting Visibility and Other Restrictions

In addition to suspension and termination, we may take lesser actions against an account or content at any time and in our sole discretion, including limiting, restricting, or removing the visibility, reach, or distribution of any content or account; disabling specific features for an account; removing content from search, recommendations, or feeds; or restricting an account’s ability to interact with other users. We may take these actions with or without notice, and we are not required to disclose that we have done so.

17.5 Law Enforcement and Preservation of Information

BikerOrNot may preserve, access, and disclose account information, User Content, and other data when we believe in good faith that doing so is reasonably necessary to comply with the law or legal process; to respond to lawful requests from law enforcement or government authorities; to enforce these Terms; to detect, investigate, prevent, or address fraud, security, or safety issues, or other illegal or harmful conduct; or to protect the rights, property, or safety of BikerOrNot, our users, or the public. We may cooperate with law enforcement investigations and may preserve content and records related to suspected violations or illegal activity.

17.6 Effect of Termination

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

18. Modifications to the Terms and the Platform

18.1 Modifications to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of significant changes by posting the updated Terms on the Platform and updating the “Effective Date” above. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.

We encourage you to review these Terms periodically. If you do not agree to any modified Terms, you must stop using the Platform.

18.2 Modifications to the Platform

We are continually evolving the Platform. We may add, change, suspend, or discontinue any feature, functionality, or the Platform as a whole, in whole or in part, at any time and with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any feature, except where prohibited by applicable law.

19. General Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BikerOrNot regarding the Platform and supersede all prior and contemporaneous agreements.

19.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

19.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

19.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may freely assign these Terms.

19.5 Force Majeure

BikerOrNot shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, war, terrorism, pandemic, government action, or internet service provider failures.

19.6 Feedback

If you choose to submit comments, ideas, or suggestions about the Platform (“Feedback”), you agree that we may use the Feedback without restriction and without any obligation to compensate you, and that we are under no obligation to keep the Feedback confidential.

19.7 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights in any person or entity.
