Foreclosure Crisis, Lender Deceptions, Biased Courtrooms, Consumer Responsibility and Disadvantages

As it pertains to this nation’s foreclosure crisis, people without legal knowledge, as well as without means to pay a skilled lawyer are grossly disadvantaged. Also, there is too often the problem of judges favoring more affluent or politically connected litigants. Additional irony to this equation is that if person does not have knowledge of the law, he or she is not likely to even recognize when circumstances require judicial oversight (and statute of limitation might run).

Prior to the foreclosure ‘produce the note' challenge, typically people who become delinquent on their mortgage loan, packed up and moved out for fear of their belongings being put out on the sidewalk. But a person with some knowledge about the law is both mindful of (unintentionally) default on the loan, as well as observant that the entity repossessing the property has a lawful right to do so, and that collection of that loan is not being done in an unfair or illegal manner. (If fraud, unfairness, or illegality reach a stage of injury, an additional matter other than foreclosure might result, as the Fair Debt Collection Practices Act, the U. S. Constitution, and Civil Rights are basic entitlements to every citizen.

Upon the borrower’s default, the mortgage lender is usually entitled to reclaim the property; yet it needs to be the lender which has valid ownership of the mortgage loan (the note). Several illustrations: If a loan I originally made with Tom was purchased (like buying stock) by you, would you be pleased if Tom returned to claim payment? Or, if you sought to collect payment from me, although I originally borrowed from Tom, don’t you think you should have proof that now I owe the debt to you and no longer to Tom? In legal terms, authority to enforce collection of a debt in court is called “standing.” Supposed I have a loan for property which I had been paying to someone named Dolores, but I lost my job and defaulted on the loan. I move out because Tom sent me notice that he was foreclosing. However, you own the note for the loan; and when a fire occurred on that property you found out I moved out months ago. I don’t know where I put the notice from Tom –but does it help if I did? Such basic scenarios are consumer matters which could cost lots of time, worry, and money to straighten out. In my opinion, Keep It Simple Stupid was not, is not a good cliche in light of life's complexities and people's varied frames of reference.

By the same token, the same theory about which lender rightfully owns the loan note, should apply for any type of loan debt being demanded by someone claiming to be the lender's hired agent. Unfortunately, the appalling and incredible reality is that some borrowers are primary targets for scams. Inadequate knowledge of the law and one's rights can render a person seriously victimized. To reiterate, the problem about not knowing enough about law is that when certain things happen to some people, they don't recognize those things are even weighty enough to obtain a lawyer's advice --not to mention affordability of a consult. Accordingly, one thing each of us can do is start becoming familiar with simple legal concepts, and build a knowledge base (something like getting familiar with carpentry, plumbing, or something in case of needing to know what to do).

I cannot refrain from mentioning those who are more-than-annoyed about what is termed "dead beat" borrowers. I appreciate that there is some measure of merit to that annoyance. However, permit me to interject that most times we don't know the whole story behind how or why people might appear to be, or they might actually be deadbeat. We WOULD BE AMAZED at what took place in some people's lives to cause them to be where they are. Another thing is that, for those who are pleased with themselves for being savvy enough to get good mortgage plans, or not borrow too much money, or have foresight to know they would be laid off, or divorced- and are pleased with themselves at being able to timely make payments- again, I can't help but think if whole stories were known about how some people came to their financial predicaments, empathy rather than disdain would be the appropriate reaction. In fact, for some people, it was indeed an unfair, corrupt court system which, instead of meting justice, inflicted additional hardship and agony. Also, often people who make savvy choices do so as a result of being enlightened or educated at some point. But prior to obtaining knowledge and insight, most people make unsound or unwise decisions from time to time. Since not everyone has the same ability to acquire essential information, and not everyone acquires knowledge via the same means, in these troubled times, there is not much room for scorn. (Incidentally, it is clear from news reports that some people's valued education and good fortune derives frompolitical connections and cronyism. As such, their opportunities are better. Sadly, some of those people sit on courtroom benches and do injustice by making deals with lawyers, and committing other inequities.) A powerful truth: Proverbs 30: 7-9.

Now, dire economic conditions has finally prompted tangible corrective actions from Congress and various lawmakers most capable of doing something about certain causes and effects of this nation's crisis that are beyond the average person's control. And, some people are beginning to increase their knowledge base, and not just on law. Medical setbacks, unemployment, scams, divorce and so on are rocking people's world. Mine became rocked several years ago, and I have been an unintended activist ever since. (I have spent almost all of my time and resource advocating for change; and for more than 5 years I have suffered SEVERE reprisals for resisting oppression, injustice and for helping others.)

Having said all the above –although the Bible ranks first in my heart, if there are ever any reading materials I’d suggest relative to lending and borrowing (and that’s the average person), those would be the newly published report from The Brennan Center for Justice entitled, “Foreclosures: A Crisis in Legal Representation,” and the October 5, 2009 article, “Lack of Legal Help: One More Way the Deck Is Stacked Against Homeowners,” by Arianna Huffington -the Huffington Post. (Both of these can be viewed online.)

Had Lived as an Independent Cross Country Solo Rider for the most part for many years; This period was 1982 - 1999: Some rare occasions you’d also find me trucking cross country with my scoot strapped behind the truck’s cab. (better pay then doing my yearly massages for a week at Sturgis or the pay from the mags). Truly the Hot-Showers, roof-over the head, I was happy w/ the floor, (sure did love that beds or couch when they came around too)the use of your garage & equiptment so I could do some wrenching, rebuilding, re-wiring & re-construction, ect, ect... THANK-YOU!! It was truely appreciated more then I can Ever Express, and I have Never Forgot! I always tried to return the favors to ya, during my stays by Cooking, Cleaning, yard work, motor repairs what-ever I coould find to help you with. My motto was "To be always welcomed back again". Thanks again for the Clean Cloths & helping getting my old motorcycle “back on the road again” sooooo appreciated!

* Various biker magazines & some others back then, paid me "weakly" (as in very Little money) for this womens unique insights of our lifestyles, comparables of the people from town to town, & pic/stories of biker functions from coast to coast; the pay sucked; Even had my own column "Freedoms Wind"; BUT: Best part was Always Being Welcomed: people knew of me, and really always came through in helping me find parts for an old 64 Triumph that always losing it muffler & kick stand. (Wow the coat hangers I went through.)And ALWAYS had a Very Memorable Time. Thanks to those of whom tried so hard to fix that, nothing ever worked as good as them coat hangers for keeping the exhaust brackets tight...

Wanted to send out major thank you’s to all those that invited this women; then known as “Freedom” into their homes when I was OTR or Brokedown or just "Broke". Thanks for drinks & the Damn Great Time!


Good Lord, after the long bout of road tripping on the bike I called "Slimy Limey", aka: "Freedoms Wind"; it had started off as a 64 Triumph... ended up like Frankenstein after all them years. Sure wish I had some pics of that ol scoot after that trip. Sure would have won a rat bike show. But it was not "ratted out" on purpose like SOME people do On Purpose. Nah, mine was necessities: "Just to Get er Down The Road." You can see the Slimey Limey from "Pre Rat days" in my history photo album. This bike ran with the help:
